All models, actors, actresses and other persons that appear in any visual depiction, whether of actual or simulated sexual activity or otherwise, that is contained in the website were eighteen years old or over at the time of the creation of such.
For the purposes of 18 U.S.C. § 2257, the owners and operators are not the primary or secondary "producers" of any content containing explicit sexual conduct, real or simulated, accessible on the website. The operator of said website just performs the activities of transmission, storage, retrieval, hosting, or formatting of content, which may show explicit sexual acts, that appears on the website because of actions taken by third-party users. All portions of the website that feature such user contributed content are under the control of the relevant users. The operators are consequently exempt from compliance with Section 2257 records keeping and labeling obligations as per 28 C.F.R. §75.1(c)(4). Any content that is held to be illegal, obscene, harmful, harassing, defamatory or in any way antithetical to the terms of use and policies of the website, may be removed at the operator’s or owner's sole discretion, in accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).
Any visual depictions that may appear on the website, for which the operator of the website may be regarded as the “producer,” are exempt from the provisions of 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for one or more of the following reasons: (1) the images or videos do not show any sexually explicit conduct as laid out in 18 U.S.C. § 2256(2)(A); (2) the images or videos do not show depictions of the genitals or pubic area after July 27, 2006; (3) the images or videos do not show simulated sexually explicit acts; or (4) the images or videos were produced before July 3, 1995.
The operator of the website has assigned a custodian to be the keeper of original records as necessitated by 18 U.S.C. § 2257 and 28 C.F.R. Part 75. The records are in the care of said custodian and can be perused by sending a request via our contact form.
